Welcome to The Ellipses Collection!
This online platform (Platform) is operated by The Ellipses Collection Pty Ltd trading as The Ellipses Collection ABN: 63 686 957 997 (we, our or "us"). It is available at www.ellipses.com.au (Website/Site) and at any other third-party application we choose to use now or in the future (Platform).
The Ellipses Collection operates this Platform, including all related information, content, features, tools, products and services to provide you, the customer, with a curated shopping experience (the “Services”). The Ellipses Collection is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Acceptance
By accessing and/or using our Platform, each user of our Platform (you or your) you promise that you:
- have reviewed these terms and conditions, including our Privacy Policy (available on the Platform) (Terms);
- have the consent of your parent or legal guardian (if you are under 18 years of age) to use the Platform;
- have the legal capacity to enter into a legally binding agreement with us; and
- agree to use the Platform in accordance with these Terms.
Registration
You can browse and view the Platform as an unregistered user, however you may be required to register on the Platform and create an account (Account) to access some features, such as the purchase of goods, services and any other products (including digital content) (Goods).
Our Contract
When you place an order via our website (Order), you will receive an acknowledgement e-mail confirming receipt of your Order (Acknowledgment). The Acknowledgement is not our acceptance of your Order. A contract between us will not be formed until we send you confirmation by e-mail or other digital means that the goods in your Order have been dispatched to you (Confirmation). Only those goods listed in the Confirmation will be included in the contract formed, which includes both physical goods and digital products, such as downloadable files or content delivered electronically.
If you make more than one Order, a new offer to purchase will be created each time you place an Order.
The Ellipses Collection reserves the right to accept or decline your order for any reason at its discretion.
We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as The Ellipses Collection may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Access and Account
By agreeing to these Terms of Service, you represent that you are at least the age of 18, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all your account activity. You may not transfer, sell, assign, or license your account to any other person.
Privacy and availability
We use our best efforts to try and ensure that all details, descriptions and prices that appear on this Website are accurate, however errors may occur. If we discover an error in the price of any Goods advertised, we will correct the error within a reasonable time.
Delivery costs will be charged in addition to the purchase of Goods at our discretion and depending on your location; such additional charges are clearly displayed where applicable and included in the “Total Cost” at checkout.
Payments
Any payments will be made through our third party payment processor or by any other payment method set out on the Platform. To the extent permitted by law, our service fee is non-cancellable and non-refundable. We reserve the right to set out a number of payment methods on the Platform. Where a Third Party Payment Processor is used, that Payment will be subject to additional terms and conditions (Third Party Terms). Please review any relevant Third Party Terms before using your selected payment method.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made on our Platform. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorised to use such credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges, and all applicable taxes, if any.
Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your Acknowledgement e-mail. Unless expressly stated otherwise, posted prices do not include shipping, handling, customs, tariffs or import charges.
Prices posted on our website are in Australian Dollars and include GST as applicable.
Prices posted in our online store may be different from prices offered in physical stores/markets/conventions or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
Unless we are traveling, we endeavour to pick and pack your order 2-3 weeks after receiving your Order. We will absolutely do this earlier where possible.
For any items that are regarded as PREORDER, we will ship these out as soon as practicable after receiving the Goods. All orders placed with PREORDER items will be sent together. If you want your other items earlier, please place separate orders as we will not split your orders.
If we have not already processed your order, it may be possible to combine orders. Please email us at hello@ellipses.com.au with your order numbers you wish to combine (orders must be made in the same name). If we do combine your orders, we will issue a refund for the difference in our postage costs after we send your Orders.
Delivery of your Order
(a) When delivering Goods purchased on the website we will only deliver to the individual listed on the Order, and where requested, you must provide us, or our third party couriers (where applicable), with acceptable forms of identification on delivery, such as a passport or drivers’ licence to enable us to verify your identity.
(b) You must be present at the delivery address to accept delivery of your Order. If you are not present at the delivery address at the time we deliver your order, then you will be notified that we, or our delivery company, tried to deliver your Order. We may attempt to re-deliver your Order. If you provide an incorrect delivery address or you are not present to accept delivery of your Order after a number of attempts have been made to deliver your Order, we may cancel your Order and provide you with a refund. Where the contents of your Order allow, you may authorise us to leave your Order at your delivery address outside.
(c) All standard orders in Australia are delivered personally by our representative or sent by a postage provider of our choice without insurance but with tracking where possible. The choice of delivery method will be dependent upon your physical location and any options you select at checkout when placing your Order.
(d) While we do everything we can to ensure your order is delivered in a timely manner, we will not be liable for any loss or damage incurred by any person as a result of delay caused by our carrier that we have no control over or by any event which is out of our reasonable control or foresight including but not limited to any delay caused by an incorrect delivery address being provided to us.
(e) All delivery times are estimates only and are not guaranteed.
(f) Insurance is available at an extra cost on all delivery services. We will not cover any loss of goods that are not insured.
(g) For non-delivery of Goods, please notify us by email as soon as possible.
(h) In the event of a failed delivery due to incorrect address details provided by you, we reserve the right to charge a re-delivery fee.
(i) Where your Order include digital products (such as downloadable templates, resources or guides), we will make those products available to you electronically. This may include providing access via email, download link or a secure client portal. It is your responsibility to provide a correct and functioning email address and ensure your device is compatible with the digital format provided.
Receipt of Goods
(a) For physical Goods, you must inspect the Goods immediately upon their arrival and if the Goods are not in accordance with the specified requirements, then you must give notice to us within 24 hours of receipt of the Goods. If you fail to give such notice, the Goods must be deemed to be in all respects in accordance with the specified requirements. No claim must be recognised unless made in writing and received by us within 48 hours after receipt of the Goods by you.
(b) This paragraph does not apply if the Goods are subject to consumer guarantees imposed under the Australian Consumer Law — where consumer guarantees apply.
(c) If you experience any issues accessing or downloading digital products, you must notify us as soon as possible and within a reasonable timeframe. We will make reasonable efforts to assist you in accessing your purchase.
Refund and Cancellation Policy
Please choose carefully. We do not offer refunds for change of mind or incorrect choice, unless required under Australian Consumer Law.
Returns cannot be accepted on sale items or gift cards.
Returns cannot be accepted on “oopsies”, “B-grade”, “less than perfect” or similar items. These are products that already have some defects and are sold at lower prices to reflect their reduced quality.
At our discretion, if you cancel an order within 2 hours of placing it and the shipping label has not been created, you may receive a refund minus a 10% restocking/processing fee. All cancellations are handled on a case-by-case basis and may be denied. All cancellations must be emailed to hello@ellipses.com.au. Cancellations are not accepted for custom orders or PREORDERS.
Unfortunately, sometimes mistakes do happen. We are happy to try to make things right.
If your item is damaged or faulty, or your order contains an incorrect item or is missing an item, please follow these steps:
- In line with our Terms of Service, inspect your Goods immediately upon their arrival and give notice to us no later than 48 hours of receipt of the Goods.
- If your order is missing an item, please double check your parcel before contacting us. Missing items may still be in the package hiding under packaging material or down the side or stuck to another item in the order.
- Take a photo of the item/s clearly showing the issue/s.
- Send the photos to hello@ellipses.com.au along with your order number and a brief description of the issue.
- After we have reviewed your case, we will contact you to inform you of the outcome. Should you be requested to return incorrect items or we issue replacement items, you will not be responsible for shipping costs.
To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase. Returns will need to be sent to: The Ellipses Collection Pty Ltd PO Box 2110, SALISBURY EAST, QLD 4107.
If your return is accepted, we may send you a return shipping label, as well as instructions on how to send your package. Items sent back to us without first requesting a return will not be accepted.
After we receive and inspect your return, we will let you know if your refund is approved or not. If approved, you will be refunded to your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund. If more than 15 days have passed since we have approved your return, please contact us at hello@ellipses.com.au and we will follow up on our end.
Collection of information
We collect personal information about you in order to enable you to access and use the Platform, to contact and communicate with you, to respond to your enquiries and for other purposes set out in our Privacy Policy which can be viewed here. Shopify’s Privacy Policy can be found here. By using the Services, you acknowledge that you have read these privacy policies.
Intellectual Property rights
Unless otherwise indicated, we own or licence all rights, title and interest (including intellectual property rights) in our Platform and all of the Content. Your use of our Platform and your use of and access to any Content does not grant or transfer to you any rights, title or interest in relation to our Platform or the Content.
You must not, without our prior written consent or the consent of the owner of the Content (as applicable):
- copy or use, in whole or in part, any Content;
- reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any Content to any third party; or
- breach any intellectual property rights connected with our Platform, including (without limitation) by:
- altering or modifying any of the Content;
- causing any of the Content to be framed or embedded in another website; or
- creating derivative works from the Content.
User Content
You may be permitted to post, upload, publish, submit or transmit relevant information and content, including Reviews (User Content) on our Platform. By making available any User Content on or through our Platform, you grant to us a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free licence to use the User Content, with the right to use, view, copy, adapt, modify, distribute, license, sell, transfer, communicate, publicly display, publicly perform, transmit, stream, broadcast, access, or otherwise exploit such User Content on, through, or by means of our Platform.
You agree that you are solely responsible for all User Content that you make available on or through our Platform. You represent and warrant that:
- you are either the sole and exclusive owner of all User Content or you have all rights, licences, consents and releases that are necessary to grant to us the rights in such User Content as contemplated by these Terms; and
- neither the User Content nor the posting, uploading, publication, submission or transmission of the User Content or our use of the User Content on, through or by means of our Platform will infringe, misappropriate or violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
We do not endorse or approve and are not responsible for any User Content. We may, at any time at our sole discretion, remove any User Content.
Use of AI
We may use tools powered by Artificial Intelligence (AI) in our store to enhance your experience when browsing or interacting with our store, including:
(a) AI chatbots or virtual assistants to answer common customer queries or guide you through the purchase process;
(b) Automated systems that offer product suggestions based on your activity or preferences;
(c) Tools that enhance or generate product images, mock ups or written descriptions; and
(d) AI powered help desk or ticketing systems that help us manage customer services communications.
Where AI tools are used to assist you, a human team member supervises or reviews interactions where necessary, and you may request to speak or interact with a human at any time.
Discontinuance
We may, at any time and without notice to you, discontinue our Platform, in whole or in part. We may also exclude any person from using our Platform, at any time at our sole discretion. We are not responsible for any Liability you may suffer arising from or in connection with any such discontinuance or exclusion.
Our Products
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colours or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
Consumer Guarantees
(a) Certain legislation including the Australian Consumer Law (ACL) in the Competition and Consumer Act 2010 (Cth), and similar consumer protection laws and regulations may confer you with rights, warranties, guarantees and remedies relating to our provision of our services which cannot be excluded, restricted or modified (Statutory Rights).
(b) Nothing in these Terms excludes your Statutory Rights as a consumer under the ACL.
Limitation on Claims
(a) We have no liability to the extent that our performance of the contract is prevented by force majeure. For these purposes, “force majeure” means any occurrence or omission as a direct or indirect result of which we are prevented from or delayed in performing any of our obligations, is beyond our reasonable control and which could not have been prevented or mitigated by reasonable diligence or precautionary measures, including forces of nature, natural disasters, acts of terrorism, riots, revolution, civil commotion, epidemic, industrial action and action or inaction by a government agency.
(b) We have no liability to the extent that a failure of the Goods is attributable to any act or omission on your part, including but not limited to where you do not follow appropriate storage instructions for the Goods.
(c) Our liability for failure to comply with a consumer guarantee is limited to:
(i) in the case of Goods supplied by us, the replacement of the Goods or the supply of equivalent Goods (or the payment of the cost of the replacement or supply); and
(ii) in the case of services supplied by us, the supply of the services again or the payment of the cost to the Customer of having the services supplied again.
(d) Subject to the prior, no attempt is made to exclude or limit liability arising under the Australian Consumer Law to the extent that there is a statutory restriction on such exclusion or limitation.
(e) In all other respects, our total liability for loss or damage of every kind, whether:
(i) arising pursuant to the Terms of Service; or
(ii) arising in any other way out of or in relation to the supply of the goods, their sale, delivery or the way they behave, and whether in tort or contract or in any other cause of action, is limited to an amount equivalent to the sum paid by you to us for the goods.
(f) Except as otherwise stipulated in these terms, we do not accept liability to you in respect of any indirect or direct loss or damage which may be suffered or incurred by you in respect of goods or services supplied pursuant to these terms.
(g) Where you have asked us to recommend a product for your use, we make such recommendations on the information provided to us by you and will not be liable if the products purchased fail to meet your requirements, particularly where we have not been made aware of the full circumstances of the intended use or your specific situation.
(h) This clause will survive the termination or expiry of these Terms.
Warranty disclaimer
To the extent permitted by law, any condition or warranty that would otherwise be implied into these terms and conditions is excluded.
Indemnity
You agree to at all times indemnify us and keep us indemnified from and against any loss (including legal costs on a full indemnity basis) or liability we incur arising from any claim, demand, suit, action or proceeding by any person against us where such loss or liability arises out of or in connection with your conduct, your breach of these terms of use, your use of this Website or Platform, any information you provide via this Website, or any damage you cause to this Website.
Waiver
Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by us. Without limiting the foregoing, if you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
Infection control
While we use the best hygiene possible at our end, we cannot guarantee that the packaging is free of infection and we recommend that you also exercise precaution by using hand washing and sanitisation following when unpacking the products. We reserve the rights to rely on indemnity in this regard.
Relationship with Shopify
The Ellipses Collection Pty Ltd is powered by Shopify, which enables us to provide the Platform to you. However, any sales and purchases made in our Store are made directly with us. By using the Platform, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and us, including any injury, damage, or loss resulting from purchased products or services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to Your purchases and transactions with us.
General
Variation: We may modify these Terms from time to time by posting the amended Terms on the Platform. By continuing to use the Platform after any such modification, you agree to the amended terms. If you do not agree to the modifications, you must terminate your Account and stop using the Platform.
Severance: The provisions of these Terms are severable and if any provision of these Terms is held to be void, invalid, illegal or unenforceable, that provision is severed from these Terms without affecting the validity or enforceability of the remainder of that provision or the other provisions in these Terms.
Jurisdiction: These Terms, and your Order, are governed by the laws of Western Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in Western Australia and any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts.
Entire Agreement: These terms constitute the entire agreement between you and us.
